Dear Mr. Holscher,


I believe one of your clients – Mr. Randy “Duke” Cunningham – was involved in a traffic accident with my wife and I (I was driving) on February 25th, 2005 about 8:35 pm on Mission Road in San Marcos, California.

I had a pretty good view of the other driver and am prepared to swear in court that I believe unequivocally that it was Mr. Cunningham. However, in consideration of his actions the following Monday, I have no desire to pursue this matter.

I would be very grateful if you would deliver the enclosed personal letter to Mr. Cunningham. If he wishes, I will bring the car part referenced in the letter to your office for you to deliver to him. When I no longer possess the car part (a wheel well liner from a Chevy Tracker) I will consider this matter closed. I do not believe there is any chance the state would attempt to prosecute this case, either. (They don’t even seem to want the car part!)

Please feel free to contact me any time if I can answer any additional questions.

Even if it somehow wasn’t your client who ran into me (so to speak) that night (which I would appreciate knowing in that case, so I can pursue whoever it was, who has no excuse for his behavior), I still admire what Mr. Cunningham did on Monday, November 28th, 2005 in San Diego, and his pledge to cooperate with prosecutors.
